Set Aside Administration
If an estate has a net value of less than $100,000.00, it may qualify for a Set Aside Administration. This is the process of the court “setting aside” the assets of the estate by court order. The benefit of a Set Aside is that it is a very abbreviated version of a regular probate. There is only one court hearing and the entire process usually only takes about 6 weeks. While this is the preferred option in estates valued at less than $100,000.00, if the estate has multiple creditors, a Summary Administration may be preferable as it gives creditors the chance to file claims against the estate. In a Set Aside proceeding, all the debt of the estate must be paid and accounted for in the Petition. If there are extenuating or hardship circumstances, the court has discretion to disregard creditors.
